Negligence is basis of medical malpractise cases.
Four elements are required to prove negligence:[1]
- Duty of care.
- The patient had a patient-physician relationship with the physician in question.
- Breach of the standard of care.
- Foreseeable harm caused by a breach in the standard of care.
- Damages.
