Negligence is basis of medical malpractise cases.

Four elements are required to prove negligence:[1]

  1. Duty of care.
    • The patient had a patient-physician relationship with the physician in question.
  2. Breach of the standard of care.
  3. Foreseeable harm caused by a breach in the standard of care.
  4. Damages.
